What exactly is a damage claim?

A damage claim seeking financial compensation for physical, emotional and psychological harms may be brought by an injured person against the abuser. If the injured person is a child, a case may be brought on their behalf by a parent or guardian. Damages can be claimed for medical care, therapeutic care, the future impairment of overall capacity to live daily life, and for emotional damages. The claim is argued in civil court as opposed to criminal court, which makes a difference. Why? In civil court, the standard of proof required to win a claim is far less stringent than that of the criminal courts. You need only provide proof by a preponderance of the evidence as opposed to the "beyond a reasonable doubt" standard required for a criminal conviction.
